Assault Criminal Defense
Assault: Assault and battery charges can be as simple as a slap, usually charged as a misdemeanor battery, all the way up to assault with intent to commit serious bodily injury, or assault with a deadly weapon. These charges are punishable as felonies and cannot be reduced to misdemeanors even if the court places you on probation. If the victim is actually seriously injured or if a weapon is used, the charge is considered a “strike” for California’s Three Strikes Law. This will increase the punishment for the present offense as well as increase punishment for any felony committed in the future.
Assault cases can often be mitigated, dismissed or won outright with a thorough investigation of witnesses and sometimes the background of the “victim”. Oftentimes, the prosecution checks the record of the party that is charged, but not all of the situations that surround the assault. With a thorough investigation and the surrounding facts on my side, I have been successful in working with the prosecutors to drop charges in some cases. When the prosecution is unwilling to dismiss, I am ready for trial at an early stage before witnesses have forgotten what they saw, or moved away from the area.
