A 19 year old Texas man faces 5 years to life in prison for baking brownies.

Instead of using marijuana to spice up the brownies, he used hash oil. Had he used marijuana in the brownies, he would have been guilty of a misdemeanor. However, hashish oil is a different controlled substance, even though the active ingredients have similar effects.

In Texas, because the oil was used to substitute for vegetable oil, the entire weight of the baked goods, including flour, chocolate, sugar, and eggs was computed to reach the weight of approximately 1.5 lbs. The entire weight of the brownies is considered the weight of the illegal controlled substance, a result that makes very little sense.
