Drug Charges: Drug charges range from the recreational occasional use of an illegal drug, to the constant use and possession and sometimes sales and theft behavior of an addict, all the way to the sales of illegal drugs as a business, where sellers would never think of using the product they are selling in bulk. The statutes, to a large extent, punish each type of behavior, or try to rehabilitate it, in accordance with the crime. Many people with drug problems may not be arrested for drugs at all, but instead arrested for theft, embezzlement, or other crime that the addict would never have committed if he/she was not so sick.

 

I have dealt with drug cases in several different ways, keeping in mind first whether or not the prosecution can prove my client guilty, and whether or not the police have violated my client’s constitutional rights in order to make an arrest. I have been successful in getting physical evidence suppressed due to illegal search and seizure or error in interrogation, in drug cases where police have not honored my client’s constitutional rights. By having the experience to spot these issues as well as the knowledge of the ever-changing law of search and seizure, I can determine whether to try to settle a case, or to push on towards motions to suppress or dismiss the case.

 

For those cases where a client has been righteously and legally arrested and charged, I can work with the family to bring out psychological issues that may be present, tied in with drug rehab. I have had clients who have been seriously addicted to drugs or alcohol tell me, after rehabilitation work, that they are so grateful to have their life back. Because I am familiar with the courts, the prosecutors, and the programs, as well as the process of rehabilitation, I am able to steer the client who is in the system because he/she is an addict in the right direction, rather than merely push a bad defense case forward to motions and trial simply because the client is in denial.
