The most common and unsophisticated internet crime is possession or distribution of child pornography. Many times parties who would never think of looking at or purchasing child pornography in print form find themselves drifting toward that area after surfing other “adult” sites in the privacy of their own bedroom. This is often associated with drug or alcohol use or sometimes mental health issues that fuel the compulsion. Penalties for possessing this type of material are very stiff if the case is filed in federal court and often result in a federal prison sentence far from home. If the case is filed in state court there is always the threat it will be removed to federal court, whether or not the state case is settled.
I have worked with individuals who have sought my services after the FBI has knocked on their door and asked them about the contents of their hard drive. In some cases, I have been successful in the case not being filed at all in federal court, or reached a favorable settlement for these types of cases in either state or federal court. I have often worked with mental health professionals in these cases in order to reach a better settlement.
