California Law prohibits both school and cyberbullying and harassment of students. Numerous sections of the California Education Code make it illegal and sometimes a hate crime to cause students to be placed in fear of their safety, including by video, text, false images and profiles. Although many older people remember playground scuffles and name-calling, bullying in present times has become much more sophisticated. Most students have cell phones and information that is disturbing and dangerous to the health of a student is freely exchanged. There are also laws that specifically make it illegal to commit cyber sexual bullying, which is likely self-explanatory. Intimidation, discrimination and harassment of LGBTQ students is also specifically prohibited under Seth’s Law. Many of us have read news articles on the internet about students who have commited suicide as a result of being harassed and/or bullied by their peers. This is illegal behavior under the Education Code and schools are made aware of their duties.
